It is for Us a motive of pride that our celebration this year of the world human rights day be marked by the appending of the Royal seal on Our dahir, setting up “Diwan Al Madhalim”.
Thus, We consolidate the bodies that are entrusted, under our aegis, to correct iniquities, uphold rights and safeguard freedoms, such missions that are part and parcel of the most sacred duties of the King, the Commander of the Faithful.
By doing so, We are following the path drawn by Our Glorious Ancestors who were constantly keen on setting up at their side institutions entrusted with informing them on the injustices that their subjects might suffer from and to correct up the contingent errors and abuses, committed by administration officials.
We are thus consolidating the gains achieved by Our Venerated Father, His Majesty King Hassan II, may God rest his soul in peace, in the realm of the protection of the rights and freedoms of citizens, by ensuring a modern judiciary protection through administrative courts, and a political protection, through the human rights advisory council.
On the other hand, by setting up “Diwan Al Madhalim”, We confer another tangible dimension on our concept of authority, based on the necessity for this authority to be an authority of proximity, at the service of citizens and development, an authority committed to the rules of prevalence of Law and Justice.
We were keen on making of this institution an efficient instrument for the promotion of mediation between the citizen and the administration, a flexible and simplified conciliation tool, to handle the complaints and claims of Our faithful subjects, and an efficient recourse for those who deem they have been harmed by a decision or an act considered unjust or contrary to the law, that was taken by an administration or a body empowered to exercise the prerogatives of public power. We are intending to relieve the human rights advisory Council from the complaints having an administrative character and consolidate the outstanding role that we are expecting the council, in its future composition, to assume in the realm of rights and freedoms protection.
This path, that prompts us to draw inspiration from our Islamic generous and tolerant Chari’a, from our traditions and from the values of our civilization, to find Moroccan answers to Moroccan concerns, has not prevented us from opening onto the lofty ideals of the shared human heritage and to profit from the experience of similar institutions in contemporary systems. The setting up of “Diwan Al Madhalim” at Our side is likely to confer on it all the required autonomy and independence.
On the other hand, in a bid to bring “Diwan Al Madhalim” closer to citizens, We have decided that it will have delegates in our Prime minister's office and in other ministries. We equally insist that “Diwan Al Madhalim” have, in the future, regional and special delegates.
In a bid to avoid that “Diwan Al Madhalim” be solely a bureau of petitions, but equally a force of proposal for the reform of legislative texts, administration and justice – a process that We are resolutely carrying on— We have mandated it to submit to Our Majesty an annual report on the issue, besides the presentation of its remarks, recommendations and periodical reports to our Prime minister and to the human rights advisory council.
Through this institution that is part of the measures We have adopted to reconcile the citizen with the administration, We put an end to the citizen’s feeling that there is a lack of communication on the part of the authority, alleviate the weight of bureaucracy and moralize public service, and confer a strong weight to the concept of citizenship.
We pray God the almighty to help Us make Our people progress constantly farther on the path that We have taken in order to materialize our aspirations to perfect the edification of the rule of law, make the values of justice and equity prevail and correct inequities, whatever their origin.
